It will air in certain Primus and CGV theaters and has less screenings than the other productions.

We at DBSKnights believe it is our duty to report all news on DBSK. But please read this article with the understanding that not everything that the news reports is definite fact



The three members of TVXQ who have taken legal action against SM Entertainment are planning to work by themselves, according to their legal counsel.

When Sports Seoul asked the three members' legal counsel about SME demanding the three members to make a decision by the 12th, they were told:
"The three members are taking a break at the moment and are planning new projects. We do not plan on responding to SME's press conference. SME was ordered by the court to submit relevant evidences and they have been ignoring this order for almost 3 months now and they also have not been following any other court orders. Conversations with SME will start when they start respecting the court's decision. The court said that the three members may work on their own, so we do not need SME's permission on that. We are also seriously considering making criminal accusations against SME."

[TRANS] 091028 SM-TVXQ Current Exclusive Contract Released

We will reveal the exclusive contract SM Entertainment holds with its celebrities. Exclusive Contract Periods - 'TVXQ' is 13 years and 'BoA' is 15 years

TVXQ's Kim Jaejoong finalized his contract with SM on May 14th, 2003, Kim Junsu on February 12th, 2000, and Park Yoochun on June 30th, 2003. There were five changes to the contract after this. The contract period was extended from 10 years to 13 years and the income division was slightly increased for the celebrity. However, the clauses regarding the extended contract or compensation which were ruled by the Courts as unlawful were not changed. The five changes of the contract occurred in December, 2003, February, 2007, March, 2007, October, 2008 and February of 2009.

If you look at the contract, it can be seen that SM holds almost no obligations. All there is for the agency to do is to take care of the group's popularity and tell them of their activities. On the other hand, TVXQ must follow the orders of the manager SM gives them, and cannot personally make any promises or contracts regarding activities.They cannot talk about the internal affairs of SM. If a show or performance has a setback for no special reason, TVXQ must compensate. They must make two full albums every year and must release an album six months before the termination of their contract and perform all activities diligently. TVXQ must get permission from SM to give any of their compositions or arrangements to a third party. But SM is allowed to give any SM singer TVXQ's compositions without the consent of TVXQ.

Although the income division aspect has improved, they do not receive any money until at least 50K copies are sold. If they sell 50K~100K, the group receives 2% of sales, sell 100K~200K and receive 3%, sell over 200K and they receive 5% of total sales. The group must then split this income. If the appearance on a show is not regular, SM receives all the money for publicity. If the contract is terminated for any reason, TVXQ must pay compensation worth three times the investment money and twice the amount of their forecast income as well. This also applies when both sides have agreed to the termination or when SM is the cause of the termination.


Exclusive Contract Content

Clause 1 (Purpose)
For the effective celebrity activities of 'B' (TVXQ), all legal actions dealing with all activities, appearances and such will be dealt by 'A' (SM Entertainment) or the manager chosen by 'A'. 'B' cannot make any personal promises or contracts regarding his activities and must only focus on what they have been given.

Clause 2 (Contract Period)
1. The contract period will begin at oooo. oo. oo(The latest contract signing date) and will end 13 years after the debut date of 'B' in the industry (album release, appearance as a supporting role in a movie or drama - movie: 20 scenes or more, drama: 12 scenes minimum per episode).

1. 'A' has full rights for the maintenance of all of the TV appearances and activities performed by 'B'.

During the contract period, 'B' must diligently perform all activities decided upon by 'A', 'B' is not allowed to perform any activities without the consent of 'A' during the contract period, and if this clause is violated, the appropriate consequences will be taken stated in Clause 11, subclauses 1, 2 and 3.
3. All TV appearances and authority of 'B' are held by 'A'.
4. 'A' has the rights to all albums and recorded songs (including unreleased songs) that were created during the contract period. All income division after the contract period has terminated has already been determined by the exclusive contract.
5. 'B' must give 'A' all rights such as the right to reproduce goods, copyrights, the right to release albums, distribution rights, airing rights, performance rights, karaoke, right to create second hand goods regarding any compositions, arrangements or lyrics done by 'B'.
6. 'A' is allowed to use the songs recorded and produced during the contract period in any form. ('A' is allowed to reedit and reuse any song in the form of L.P, M.C, CD, CD-FMV, DC-FMV, CD-I, CD-V, CD-G, L.D, VIEDO, limited edition albums, best albums, commercials, movies, picture, VIEDO filming, MP3, any music files.)
7. In order for 'B' to give a third party other than 'A' lyrics, compositions or arrangements, 'B' must get the permission of 'A' in advance.
8. The manager of 'B' must be chosen by 'A', and he must diligently work to maintaining the schedule of 'B'.
9. 'A' is allowed to use any lyrics, compositions or arrangements that 'B' made in any album 'A' is creating other than the album of 'B'.
10. 'A' is allowed to transfer and use all or a partial amount of the contract's content in other businesses. But if 'B' says in advance that he is completely against this, this no longer applies.

Clause 4 (Contract Mandate)

1. 'B' is not allowed to reveal to the public of the contents of the contract or the internal affairs of 'A'.
2. 'B' is responsible for adhering to all scheduled TV appearances or performances set by 'A' or the manager.
3. If a setback occurs during an appearance or a performance for a personal reason, 'B' is to tell 'A' or the manager in advance and if there was no special reason for such a setback, 'B' must take responsibility.
4. The manager of 'B' must be chosen by 'A', and he must diligently work to maintain the schedule of 'B'.
5. Between the time of the contract's termination and six months before said termination, 'B' must release one new album (recorded) that 'A' asks for, and perform activities for P.R. for said album (six months).

Clause 11 (Compensation in the case of a violation)
1. In the case that 'B' violates any of the clauses in this contract, 'B' must compensate for the losses incurred, and any actions or situations that may affect the activities of 'B' will be held accountable by 'B'. If 'A' feels that it will be hard for 'B' to continue on with his celebrity activities, 'A' has the right to stop the activities of 'B', and 'B' must compensate 'A' for the losses. (Compensation does not mean termination of the contract.)
2. 'B' must pay compensation that is worth three times the amount of investment (any money used for the purpose of 'B') and twice the predicted profit that would be gained in the years had the contract not been terminated.

Clause 12 (Disputes and other responsibilities)

The aforementioned subclause 1 only applies to the sales of official albums of 'B' and the income made by any edited goods that 'A' made (Live albums, Best albums, omnibus albums, etc.) all belong to 'A'. - in the case that 'A' releases the songs of 'B' that have already been released in a compilation album (edited album), 'A' receives all of the income. However, if 'A' releases a song by 'B' that has not been released yet in a compilation album, 'B' receives the amount of money that 'B' would receive from an album in subcluase 1 and multiply that amount by ratio of the number of unreleased songs in the compilation album. 3. 'B' will receive 10% of net profit from all online song sales (MP3 and other audio files) and albums created to target overseas markets. (In the case that the applicant is a group, the same rules of Clause 9, subclause 1 will apply.)
4. If 'A' requests that 'B' appears on an internet program that SM is producing, 'B' must do so and as the internet program is deemed as publicity for 'B', appearance payment will not be given. (The fourth amendment fixed this subclause to "Unless 'B' has a valid reason not to appear on an internet program that SM is producing, 'B' must appear when 'A' requests so but 'A' must pay 'B' for the appearance. However, if the appearance is to publicize the album of 'B'. then payment is not needed.")
5. 'B' must prioritize all broadcasting productions created by SM. 'B' will be paid 50% of the average payment given to guest appearances in cable or subscription television for all appearances on SM's programs.

4. Regarding Clause 10
-This clause in the original contract (changes made by amendments are noted) was as follows but was changed in the second and fifth amendments to the contract to change the rates of income division and was implemented on July 1st, 2008.

Original Clause 10 (Profit Division-TV Appearances, Events, Commercials, Rights)
1. 40% of payments for regular appearances on a TV program must go to 'A'.

Traveling fees and rent fees, as well as their meals, make up and coordinators' wages, dance crew and any other stage crew costs. Periode Kontrak eksklusif - 'TVXQ' adalah 13 tahun dan 'BoA' adalah 15 tahun

Kim Jaejoong TVXQ selesai kontrak dengan SM pada 14 Mei 2003, Kim JunSu pada 12 Februari 2000, dan Park YooChun pada tanggal 30 Juni 2003. Ada lima perubahan pada kontrak setelah ini. Jika mereka menjual 50K ~ 100K, kelompok menerima 2% dari penjualan, menjual 100K ~ 200K dan menerima 3%, menjual lebih dari 200K dan mereka menerima 5% dari total penjualan. Kelompok kemudian harus berpisah pendapatan ini. Jika penampilan pertunjukan tidak teratur, SM menerima semua uang untuk publisitas. Jika kontrak dihentikan untuk alasan apapun, TVXQ harus membayar kompensasi bernilai tiga kali lipat uang investasi dan dua kali jumlah perkiraan pendapatan mereka juga. Konten Kontrak Eksklusif

Ayat 1 (Purpose)

Ayat 2 (Periode Kontrak)
1. Masa kontrak akan dimulai pada oooo. oo. oo (tanggal penandatanganan kontrak terbaru) dan akan berakhir 13 tahun setelah tanggal debut 'B' di industri (rilis album, penampilan sebagai peran pembantu dalam sebuah film atau drama - film: 20 adegan atau lebih, drama: 12 adegan minimal per episode).
2. Dalam kasus yang 'B' adalah tidak dapat melakukan aktivitas normal karena alasan pribadi, masa kontrak akan diperpanjang oleh jumlah waktu.

Ayat 3 (Assignment of Rights)
1. 'A' memiliki hak penuh untuk pemeliharaan semua TV Penampilan dan kegiatan yang dilakukan oleh 'B'.
2. Selama masa kontrak, 'B' harus rajin melakukan semua kegiatan yang diputuskan oleh 'A', 'B' tidak diperkenankan untuk melakukan kegiatan apapun tanpa persetujuan dari 'A' selama periode kontrak, dan jika klausul ini dilanggar, maka konsekuensi yang sesuai akan diambil dinyatakan dalam Klausul 11, subclauses 1, 2 dan 3.
3. Semua TV Penampilan dan otoritas 'B' dipegang oleh 'A'.

JaeJoong was at the press conference for Telecinema ‘Heaven’s Postman’ on 9th November in Seoul WangSipRi CGV. This is the first time that he is attending an official event 4 months after his lawsuit against SM Ent with fellow TVXQ members Xiah JunSu and Micky YooChun.

He said, “I thought I have to participate in this press conference. This film was filmed a year back with much effort. Even though it may be a tough time now, I told myself ‘Even if for just myself, I should congratulate myself’.”


When asked if he have anything to say to Dong Bang Shin Ki fans, he said, “I know that many fans are worried. I hope that they can get some comfort from this film.”

Heaven's Postman Top Advance Sells Rating
in Korea's New Movie Release


The tele cinema "Heaven's Postman" recorded the first place
for advance sells rating in Korea's new movie release.

Heaven's Postman received interest by the Hero from TVXQ
and Han Hyo-joo from the hit drama Brilliant Legacy acting together.

The movie promotion committee's movie theater admission ticket unification network counted
the theaters advance sale data in a standard in real time 2:30 PM on November 9th, 2009.

Haeven's Postman was reported an advance sells rate of 19.1%,
which marks the first place in the new release of the Korean movies.

SM Entertainment CEO's Kim Young Min, who is involved in the ‘unfair contract’ dispute with his artistes, has recently announced a new contract policy, and that it will be put into action once it gets approved by the related authorities.

SM Entertainment Representative, Kim Young Min, who attended the press conference which was held on the 2nd of November 2009 at 63 Tower, has expressed, “We would collect all comments from music and entertainment industries, related government departments, cultural and tourism board, fair trade departments, educational circles and legislative bodies, based on the law to adjudicate a new contract policy. After the approval from the respective authorities, we would then put it into action. Then follow it (new contract policy) enthusiastically.”

Kim agreed, “If we are able to come out with a new exclusive contract policy based on the law, SM would like to re-contract with all current artistes based on it.”

Kim also expressed, “Under the new exclusive contract, the moment it’s signed it would be protected till the contract ended, if not the current situation would repeat over and over again in the future.”

“In order to prove that what have just I said is nothing but the truth, we would first like to take the advice from the impartial committee,” he said.

But, everyone was not able to fully believe this announcement by SM Entertainment. Professor Lee from Korea Art University stated, “If SM do not wish to have what they have just said to turned into nothing, then they should assure them.” He continued, “Based on what SM have said, they do not wish to fully take on the advice from the impartial committee, but to forcefully come out with a new contract policy, which was questionable (their announcement).” Professor Lee ended, “If SM was really sincere about this, they should work on the new contract based on the advice and not vice versa, and then to get it approved by the representative authorities.”

SM Entertainment CEO’s Kim Young Min, who is involved in the ‘unfair contract’ dispute with his artistes, has recently announced a new contract policy, and that it will be put into action once it gets approved by the related authorities.
SM Entertainment Representative, Kim Young Min, who attended the press conference which was held on the 2nd of November 2009 at 63 Tower, has expressed, “We would collect all comments from music and entertainment industries, related government departments, cultural and tourism board, fair trade departments, educational circles and legislative bodies, based on the law to adjudicate a new contract policy. After the approval from the respective authorities, we would then put it into action. Then follow it (new contract policy) enthusiastically.”
Kim agreed, “If we are able to come out with a new exclusive contract policy based on the law, SM would like to re-contract with all current artistes based on it.”
Kim also expressed, “Under the new exclusive contract, the moment it’s signed it would be protected till the contract ended, if not the current situation would repeat over and over again in the future.”
“In order to prove that what have just I said is nothing but the truth, we would first like to take the advice from the impartial committee,” he said.
But, everyone was not able to fully believe this announcement by SM Entertainment. Professor Lee from Korea Art University stated, “If SM do not wish to have what they have just said to turned into nothing, then they should assure them.” He continued, “Based on what SM have said, they do not wish to fully take on the advice from the impartial committee, but to forcefully come out with a new contract policy, which was questionable (their announcement).” Professor Lee ended, “If SM was really sincere about this, they should work on the new contract based on the advice and not vice versa, and then to get it approved by the representative authorities.”

[NEWS] 091105 Jaejoong will Attend Heaven’s Postman Presscon

TVXQ Youngwoong (real name Jaejoong) will finally make his first public appearance after the raising of exclusive contract issue conflicts.

On November 9th 4:30 pm at CGV Seoul, Youngwoong will attend the press conference for his debut movie “Heaven’s Postman” (director Lee Hyeong-min).

“Heaven’s Postman” which is starring Youngwoong Jaejoong and Han Hyo-joo is a Korea-Japan joint project which has been gathering much attention and become a hot issue. Through this premiere press conference, the experience of Jaejoong with his debut acting challenge in “Heaven’s Postman” will be reported.

One of the official strictly gave advance noticement, “The press conference is about the movie, and there’s no association with the legal dispute Youngwoong is involved. So I hope for the understanding not to ask any questions related to the dispute.”

Heaven’s Postman will make its debut release in CGV theaters on November 11th.

[NEWS] 091105 Yunho’s HTTG Shooting Completed



Tohoshinki’s YUNHO (Jung Yunho) has finished the last shooting for the Wed & Thurs drama “Heading To The Ground” (MBC).

A related person said on Nov 3 “The last shooting was a soccer scene. It was piercingly cold so that it was much difficult than previously shootings. The staffs wore thick jackets, but all the actors playing soccer (including Jung Yunho) only wore soccer wear (short pants), so it should have been difficult.”

This day, Jung Yunho shot a scene being accidentally toppled by another player, committing many fouls. But he did not forget to smile till the end, and have done his best. All were very impressed. The other actors was influenced by Yunho, and pumped up thinking “Let’s take care of ourselves not to be injured, and hang on till the end”.

[NEWS] Lawsuit may lead to TVXQ split

The possibility of Korea's top idol group TVXQ disbanding is increasing, after their agency sent an apparent ultimatum to three of the five-member boy band to return to the agency.
Speaking at a press conference on Monday, SM Entertainment chief Kim Young-min accused the three members -- Xiah, Hero, and Micky -- of having sued against the company out of greed to make more money.
Kim was speaking about the ongoing legal battle between the three members and the company. The three band members claim the contract signed between TVXQ and the management agency is unfair.
Last month, a lower court sided with the three and ruled that parts of the contract should be invalidated, paving the way for them to resume individual music and advertisement careers.
The agency vowed to bring the case to a higher court, saying the three must follow the contract as long as they continue to be part of TVXQ, and should get paid according to the current contract.
The other two members -- U-know and Max -- rendered their support for the management agency's claim, expressing hope that the other three would return quickly.
In their statement, the two stressed that all members have worked under the same contract with SM Entertainment for the past five years.
"We believe that TVXQ would not have been in existence without SM Entertainment, which created the group. We are also not willing to resume our career as TVXQ without our current agency," the statement said.
In a related movement, SM Entertainment chief Kim made it clear that although the court granted freedom to the three members to pursue individual activities, they are allowed to work as TVXQ only under SM.
The company demanded that the three members reply to its request to return to the agency by Nov. 12.
But it is widely viewed that the three are unlikely to continue to work with the management agency due to deep distrust between the two sides.

Through his acting debut of Asia's top idol star TVXQ's YoungWoong Jaejoong, viewers will be able to see the soft and romantic side of him in his portrayal of Heaven's postman with a riddle-like mysteriousness about him.

The image of Heaven's postman YoungWoong Jaejoong standing in a green field where the letters are mailed to Heaven draws everyone's attention with his looks resembling that of a romance comic book character. A necklace with feather decorations and bland colored clothes add to his mysterious air and he has shown prospect of becoming a great actor with his warm gaze and steady flow of emotion directed towards those who cannot forget their deceased loved ones. He also showed a romantic charm never before seen on stage by showing a warm, caring side to Hana who is hurt by and despises her dead boyfriend.

His acting skills of showing a man who begins to love but cannot approach his lover, and his special charm that was shrouded by secrets will captivate the audience and the hearts of women.

Heaven's Postman showed that YoungWoong Jaejoong was as successful on screen as he was on the stage.

[NEWS] 091103 Tohoshinki Yunho's Drama To Air In Japan


 [Tokyo, 3rd, Yonhap News] "Heading to the Ground", a drama starring Yunho, a member of a popular idol group Tohoshinki, will be airing in Japan with the title "No Limit~Heading to the Ground".

It will be aired on the Korean entertainment channel KNTV, from next year, 24th January onwards, every Sunday, 9.45pm. Preceding that, the first episode will be aired on the 23rd of next month.

"Heading to the Ground", starring Yunho and Ara, have 16 episodes in total. In Korea, it will air for the last time on the 4th of this month.

1st week of November the week for the Korean singers on Oricon Chart?

Korean singers are the prominent figures up on Oricon Chart for the 1st week of November. We see singers like BoA, Dong Bang Shin Ki and Big Bang, and also Korean actor-singer Ryu ShiWon up on the top 10 positions on the chart.

And on the 3rd, Big Bang’s 3rd Japanese single ‘Let Me Hear Your Voice’ is up #3 on the daily chart. And on the same day, Ryu ShiWon’s ‘Kaleidoscope’ is also up #4 on the daily chart.

[NEWS] CreaBeau speaks out on TVXQ Issue



It seems we finally have word from the company that seems to be tangled in this mess.

When the TVXQ / DBSK / Tohoshinki controversy first began, the three members and their lawyers clearly stated that the three members’ investments in the CreBeau cosmetics line did not have any relevance to the court case. The core of the controversy was the legal issues of the slave contract. In SM Entertainment's opening statement, they stated that the lawsuit was because of the cosmetics issue.

To clear up the confusion, Kang Suk Won, the President of the Korean branch of CreBeau (Wishop Plus) was interviewed. Kang has already sued SME’s CEO Kim Young Min for slander to the Seoul Central Court on October 4th, 2009.

Kang said, “Although this case is obviously to fight the unfair profit splits and the conflict between the members and SME, SME is trying to push the blame onto CreBeau.”

Kang went on to reveal that the three members have only invested approximately 70,000 dollars, 60,000 dollars, and 40,000 dollars respectively. This amount, he said, was not enough to earn the three members rights to ownership of the business, let alone a big part of the profit.

Kang said, “In May 2009, some SME representatives visited the original branch of CreBeau Cosmetics in China twice. They determined that the members were not going against contract terms in any way, and now SME is distorting the true reason behind the case and putting out ridiculous claims... SME said that the whole lawsuit was due to the members’ wanting to continue a business that went against contract terms. This has no credibility in that SME has already approved of the investments previously. The members wouldn’t risk all the things that they gained as TVXQ by creating a conflict with their company over insignificant investments. It was a private investment, and the three have no ownership over the business in any way. They’re merely investors, nothing less, nothing more. What does this have to do with the lawsuit, and why is SME attempting to connect the two together?”

Kang went on to say that SME’s actions have brought about significant harm to the business not only in Korea, but all over Asia, including China, Japan, Hong Kong, Taiwan, Vietnam, and even the United States. For the employees and CEOs all over the world, CreBeau is their sole income. SME should have considered the impact its blames would bring to the business and the people involved in it.

“If SME’s company and its profits are so important that they are willing to harm others for it, then SME should recognize that it is the same for others.” Kang went on to say that “If SME does not stop distorting the truth and doesn’t apologize for the harms it brought upon CreBeau, I will not hesitate to reveal the details of SME’s absurd act to the public and to the court.”

[NEWS] Cassiopeia releases statement about SME’s allegations

Members of the Korean Cassiopeia, TVXQ/DBSK's official fanclub, have released their official statement regarding SM Entertainment's press conference regarding legal dispute involving DBSK which took place yesterday. Here is the translated version of their statement:

We 800,000 Cassiopeians would like to announce our official view in this statement. With accusations and allegations flying everywhere, we announce this in order to show the fanclub's official standing on this matter. This statement is made by union of numerous DBSK fan cafes and we present this in the name of Cassiopeia.

First of all, we would like to say that, as fans of DBSK, we support DBSK and will not do anything to betray their trust in us. We will not trust anything besides words that come out of the DBSK members' mouths, and we ask SME to stop actions that are intended to confuse and divide the fans.

We Cassiopeians are very disappointed in SME for holding press conference and releasing signed documents in the name of Yunho and Changmin. As the management company of DBSK, SME must not forget their job and must stop their actions intended to defame the members of DBSK and break the group apart. Also, according the the court ruling made on the 27th, SME must not make deals with third parties in the name of the three members and cannot interfere with individual works or those members. Please keep the court's order.

To everyone who is reading this statement, please remember: the members did not take legal actions because of the issues regarding the cosmetics business. They started this lawsuit because of illegal contract length of 13 years. We fans do not understand why SME is silent about the issue of the contract length and is trying to focus everyone's attention on the cosmetics fiasco. The goal of this lawsuit was to nullify or edit contract between SME and the three members, and we believe that they did not intend to end DBSK or move onto another management company. Also, we would like to address to reporters who sensationalize and create rumours related to this press conference. Please be careful with your sources.

We would like to ask SME one more time to not make the three members' reputation and rights suffer with claims that have never been proven, and we would like to ask the citizens of Korea to stop creating rumours and defame DBSK. We would like to show our condolences toward this controversy.

As Cassiopeians, the fans of DBSK, we will keep our attention focused to the future actions of DBSK and SME. We will continue to side with DBSK. DBSK and fans never doubt.

which is written before her blog message I had Posted here yesterday.

The movie, “Heaven’s Postman”, is shown in a movie theaters in November of this year in Korea,
it seems to be broad casted on TV in January through February of the next year in Korea.
The main star of this movie is Jeajoong from TVXQ.
I received several inquiries from you asking me when it is going to be shown in Japan?

I want to hear it! (I myself want to know about it!)

I think that the details are not yet decided.
There is no communication from them coming to me.
This coming Friday, I intend to contact the person who are in charge of this project.

I must have courage to ask them!! (Be bold Eriko!)
